ARTICLE 1: OBJECT
1.1
The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of Goods (hereinafter the "Goods") and services offered by FACTORY JEANS to the Buyer (hereinafter "l 'Buyer").
1.2
Any order entails the unconditional acceptance by the Purchaser of these General Conditions of Sale, which prevail over any other document, including in particular any contrary stipulation on an order form or other document issued by the Purchaser. These together with the order form and, if applicable, another agreement between FACTORY JEANS and the Purchaser constitute for the purposes of the present the "Contract".
ARTICLE 2 - ORDER
2.1
The Buyer places his order online after having consulted the catalog which is at his disposal.
2.2
For the order to be validated, the Purchaser must accept these general conditions by clicking on the place indicated on the site. He will also have to choose the address and the delivery method, the billing address, validate the payment method and pay online.
2.3
The order will be confirmed by e-mail at the time of delivery at the latest.
2.4
Any order implies acceptance of the prices and descriptions of the Goods available for sale.
2.5
In the event of unavailability of the Goods, the Buyer will be informed as soon as possible and will also have the possibility of canceling his order. The buyer will then have the choice of requesting either the reimbursement of the sums paid within 30 days at the latest of their payment, or the exchange of the product.
2.6
For any question relating to the follow-up of an order, the Buyer must call 09.54.88.26.03 (Monday to Friday from 10 a.m. to 6 p.m., cost of a local call).
ARTICLE 3 - PRICE
3.1
FACTORY JEANS reserves the right to modify its prices at any time, but undertakes to apply the prices in force indicated at the time of the order, subject to availability on that date.
3.2
Prices are in euros. They do not take into account the delivery costs, invoiced in addition, and indicated before the validation of the order. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of the products in the online store.
3.3
Payment of the full price must be made when ordering. At no time can the sums paid be considered as a deposit or down payment.
ARTICLE 4 - METHOD OF PAYMENT
4.1
To pay for his order, the Purchaser has his choice of all the payment methods made available to him by FACTORY JEANS, namely: Visa, Mastercard, CB, and PayPal.
4.2
The Buyer guarantees FACTORY JEANS that he has the necessary authorizations to use the payment method chosen by him, when validating the order form.
ARTICLE 5 - DELIVERY AND RECEPTION OF GOODS
5.1
No deliveries are made to campsites, hotels, post offices and PO boxes. The Goods are delivered to the address indicated by the Buyer on the order form, which must ensure its accuracy. Any package returned to FACTORY JEANS because of an incorrect or incomplete delivery address will be reshipped at the Buyer's expense.
5.2
Reception: It is the Buyer's responsibility in the event of damage or non-compliance of the Goods delivered to make all the necessary reservations within 20 days of receipt by email at the following address: fashionsbelfort@outlook.fr or on paper available from FACTORY JEANS at the following address: FACTORY JEANS, Center commercial des 4AS, rue de l'As de carreau, 90000 BELFORT, FRANCE. Otherwise, the Goods are deemed to have been accepted as compliant and in perfect condition.
5.3
It is up to the Buyer who wishes to return the Goods for an exchange or a refund to send them within 20 days of their delivery to the following address: FACTORY JEANS, Center commercial des 4AS, rue de as of tiles, 90000 BELFORT, FRANCE. The goods must be unworn, unwashed and in perfect condition for resale, with labels and in the original packaging. The Buyer should also enclose the invoice (or a copy) as well as the reason for the return on plain paper. 5.4
The consumer can seize at his choice, in addition to one of the jurisdictions territorially competent under the code of civil procedure, the jurisdiction of the place where he lived at the time of the conclusion of the contract or the occurrence of the harmful event.
ARTICLE 6 - GOODS GUARANTEE
6.1
FACTORY JEANS guarantees the Buyer against all the consequences of hidden defects in the goods sold in accordance with the legal texts in force.
6.2
The Buyer is expressly informed that FACTORY JEANS is not the producer of the Goods within the meaning of articles 1386-1 et seq. Of the Civil Code relating to liability for defective products.
ARTICLE 7 - FORCE MAJEURE
7.1
FACTORY JEANS will be released from all liability in the event of Force Majeure. In this context, "Force Majeure" means any event or condition which is not reasonably under its control and which prevents all or part of the execution of its obligations, including in particular decisions of a public authority, fire, strikes, shortage of raw materials and loss of export permits, etc.
ARTICLE 8 - PROCESSING OF PERSONAL DATA
8.1
FACTORY JEANS undertakes to comply with the legislation applicable to the protection of personal data in accordance with the Data Protection Act.
ARTICLE 9 - PARTIAL NON-VALIDATION
9.1
If one or more stipulations of these general conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force. and their scope.

ARTICLE 10 - NON-WAIVER
10.1

ARTICLE 13 - CONDITIONS RELATING TO RETURNS AND EXCHANGES
To be returned, items must be returned in their original condition. Items must not have been worn or washed and must be in resalable condition.
Returned or exchanged items must be accompanied by labels, as well as any corresponding accessories and user manuals. No refund or exchange will be made if the returned items are incomplete, damaged or soiled.

Please return the item (s) to us by following the returns procedure as explained in the previous section.
Please indicate on the return form the item (s) to be exchanged, the reason for the exchange, as well as the color and size of the new item requested. Then include the completed return form inside the package containing the returned item.
The availability of the requested replacement item cannot be guaranteed. Your replacement order will be sent to you with the same shipping method as your original order. The delivery costs relating to the replacement order will be borne by Factory Jeans.
Once the exchange procedure is finalized, you will receive an email notification.
Refunds:
We will refund you the original price you paid for the returned item.
The full amount of returns will be credited to the buyer's original method of payment. The buyer's original bank card will be credited at the time of processing the returned items and the credit will appear on the customer's next bank statement.
Original delivery charges are non-refundable, except for cancellations by seller.
Once the refund procedure is finalized, you will receive an email notification.
